AI Tax Notices in India: How GST and Income Tax Systems Flag You

October 27, 2026 · Taxation

AI tax notices in India explained: how GST and income tax systems match returns, AIS and GSTR-2B data, and the mismatches that trigger DRC-01B or DRC-01C.

So-called AI tax notices in India rarely start with an officer reading a return. Most begin with automated data matching. The Annual Information Statement (AIS) may already hold a taxpayer's interest, dividend, securities, mutual fund and foreign remittance data. The GST portal compares GSTR-1, GSTR-3B and GSTR-2B every period.

Did you know? In CBDT's first NUDGE campaign on foreign assets, for AY 2024-25, 24,678 taxpayers, including some not directly nudged, revisited their returns and disclosed foreign assets of INR 29,208 crore (PIB, November 27, 2025).

The accompanying presentation maps each trigger. It reflects the position as of October 27, 2026.

What sits behind AI tax notices in India

The Government has told Parliament it uses data analytics, big data and AI/ML in tax administration, including prompting taxpayers about mismatches. The system flags risk; the law and the officer decide the outcome.

How the tax department selects GST notices

Under rule 88C of the CGST Rules, 2017, if GSTR-1 tax exceeds GSTR-3B tax beyond limits recommended by the GST Council, the portal issues DRC-01B . Under rule 88D, if GSTR-3B ITC exceeds GSTR-2B ITC beyond such limits, it issues DRC-01C .

Within seven days, the taxpayer must pay the difference with section 50 interest through DRC-03, or explain it, and report the payment or reasons in Part B. Until then, GSTR-1 or IFF for a subsequent tax period cannot be filed under rule 59(6)(d) and (e).

AIS mismatch notice and scrutiny selection

AIS draws on sources including statements of financial transactions under section 285BA of the Income-tax Act, 1961 (section 508 of the Income-tax Act, 2025). Mismatches can also be verified electronically under the e-Verification Scheme, 2021, made under section 135A of the 1961 Act (section 260 of the 2025 Act). CBDT's June 4, 2026 guidelines state that a return filed in response to a section 142(1) notice based on AIS or SFT information will not be taken up for compulsory scrutiny unless it falls under parameter CS 06 (specific tax evasion information from a law enforcement agency).

Will the system flag you? A quick self-check

Does GSTR-1 tax match GSTR-3B tax every period?

Is GSTR-3B ITC within GSTR-2B ITC?

Does the ITR cover every AIS entry?

Are foreign assets reported in Schedule FA?

Each "no" is a likely trigger. Fix it first.

Myth vs fact

Myth: The AI raises the demand. Fact: Recovery under section 79 (rule 88C) or demand under section 73, 74 or 74A (rule 88D) follows only if no acceptable explanation is given.

Myth: An e-campaign SMS is a scrutiny notice. Fact: It is an advisory to review and, where needed, revise.

Pre-emptive reconciliation checklist

Reconcile GSTR-1 with GSTR-3B monthly.

Match GSTR-3B ITC with GSTR-2B; act on IMS before filing.

Review AIS and TIS before the ITR; submit feedback.

Keep invoice-level reasons for timing differences.

Keep portal email and mobile details current.

Frequently asked questions

What thresholds trigger DRC-01B and DRC-01C?

The rules refer to an amount and percentage recommended by the GST Council. For DRC-01C, the 50th GST Council minutes (July 11, 2023) record a starting threshold of more than 20% and more than INR 25,00,000/-. GSTN does not publish the current limits.

How many days are allowed to reply?

Seven days under rules 88C and 88D. Replies are filed in Part B.

Can an AIS entry be corrected?

Yes. Feedback can be submitted online on each AIS entry and may be shared with the reporting source, which can accept or reject it. If the source accepts it, the source must file a correction statement.

Key takeaways

Risk systems match returns with third-party data.
